ACQUIRING THE LOT
The Mexican Government is making it a lot easier for foreign investors when purchasing land in Mexico, specially along the Mexican coast line. It has created what is called Fideicomiso, which is the Mexican term for Trust. The Fideicomiso is issued by any Mexican Bank, it is basically your title for the land but administrated by a Mexican Bank. Since the bank is involved the Fideicomiso satisfies the Mexican requirements for foreigners to purchase land in Mexico.

For investors protection
The Fideicomiso offers the investor (Fidecomitente) same legal rights as a regular land title but involves an opening fee that varies from 1 to 2% of the cost of the land, and a yearly fee that is around the 600 Us figure depending of the Bank. The term of the Fideicomiso is of 30 years, but this does not mean that you cannot sell the land when ever you wish to do so, remember you have all the rights for the land. All this is done thru a Notario Publico (Notary), who is a lawyer designated by the Government to legalize all real estate transactions. In Mexico, you can obtain clear and free title. Title searches are performed, as the Federal Government requires them. The government employs Notario Publicos to record the transfer of title at the time of closing (much different than the term, Public Notary in the US). Notarios are government appointed. They specialize in transferring real estate and have done thousands of transactions before they are considered for appointment. They must be recommended by their peers, the community, and scrutinized by the government before they become one. All real estate transactions must go through a Notario to be legal. |

Majahual is a traditional fishing village
on the Costa Maya with a few rustic seafood restaurants, about to become the best bet for a Caribbean getaway - au natural.
There is an airport, a dock and some smallish hotel and bungalow developments on the beach. The access roads in and around Majahual are being finished and will link the village to other beaches and sites targeted for development such as Rio Indio, Placer, Xcalak, Uvero, and Punta Pulticub. The Costa Maya highway will eventually stretch north to Punta Herrero, a fishing village on the shores of Espiritu Santo Bay, in the Sian Ka'an Biosphere Reserve.

CHINCHORRO REEF
A chain of reefs, part of the second longest barrier reef in the world, protect the beaches on Costa Maya. Behind the reef, the Caribbean is a patchwork of rippling turquoise and blue. Thanks to the protection of this portion of the reef system, small waves caress the shoreline of the Costa Maya. This reef, scattered along the beaches of the Costa Maya, protects your property from avulsion or erosion. In the case of a Class-7 property or better, accretion is present (where the beach is actually growing) as opposed to erosion (where you lose your beach).In 1994 new legislation was passed, pertaining to the Restricted Zone. Under this new law a Mexican Corporation, wholly owned by you can be set up. Now, you own the corporation and hold all the papers to it. Your corporation holds the deed, which means you get to possess the deed. Further, there are no annual fees to the bank and your corporation can own more than one property (you do not need to form one corporation for each property). When you go to sell your property you can either sell the corporation or sell just a property from it. Also, after you buy land via the corporation system, you are permitted to file a dormancy election, which means your company is "asleep" until you decide to activate it. The government made it very easy for foreigners to own land in Mexico. So much so that in 1998, revenues from the industry of foreign investment & tourism surpassed the revenues from the oil & gas industry. The Mexican government welcomes your participation.
